One of your fellow beer distributors brought the following information to our attention earlier today.
Effective January 3, 2012
Two DOT agencies, the Federal Motor Carrier Safety Administration and the Pipeline and Hazardous Materials Safety Administration, published a final rule on December 2nd that will prohibit the use of hand held mobile phones by commercial drivers while on the road. The use of hands free mobile phones is still permissible.
It is our understanding that drivers who are caught violating the new rule can be charged a civil penalty of as much as $2,750 and a civil penalty of as much as $11,000 can be imposed on employers who fail to require their drivers to comply. At this point, we are not sure how vigilant law enforcement will be in enforcing this new rule, but it looks like the penalties involved definitely warrant your immediate attention.
